How to Choose a Real Estate Agent in Los Cabos

How do you choose a real estate agent in Los Cabos? Start with the law: in Baja California Sur, anyone who sells, rents or brokers property for others must be licensed and appear in the state’s public registry of real estate agents, either with their own license or as an advisor registered under a licensed brokerage. Then check that the agent is a member of the MLS, so they can show you listings from every participating brokerage, not only their own. Choose someone who knows the exact community you want, interview two or three agents and ask for references from past clients. In Mexico the seller usually pays the commission, so as a buyer you get your own agent at no extra cost. This guide is for buyers from California, Texas and Arizona.

🪪 Step 1: Check the State License

In 2017, Baja California Sur passed the Law that Regulates Professional Real Estate Agents. Here is what it means for you as a buyer:

  • A license is required: anyone who brokers, sells, rents or manages property for others needs a license from the state Ministry of Tourism, Economy and Sustainability (SETUES).
  • Brokerages register their advisors: a licensed agent or brokerage must list the advisors (asesores) who work under its license.
  • It must be renewed: the license is valid for three years, with yearly renewal and continuing training.
  • The registry is public: the state publishes the list of licensed agents and their advisors online.
  • Notaries check it: before closing, the notary must verify that the agent is registered and licensed.
  • Big fines without it: working without a license carries a fine of 1,000 times the daily UMA, plus any civil or criminal liability.

💡 How to check: ask for the license number of the agent or their brokerage, then look it up in the state registry on the SETUES real estate agents page. It takes two minutes.

🤝 Step 2: Look for MLS and AMPI Membership

Membership Why It Matters to You
MLS Member agents share listings, so one agent can show you homes from all participating brokerages, not only their own
AMPI The Mexican Association of Real Estate Professionals, a national association with a code of ethics. Most established agents in Los Cabos belong to it
International brokerage A brand like Century 21 adds standard processes and a network back in the U.S.

🏡 Step 3: Choose Someone Who Knows Your Community

Los Cabos is not one market. A condo in San José del Cabo, a golf home in Querencia and an oceanfront villa in Palmilla have different prices, HOA fees, rental rules and club memberships. A good agent knows these details for the community you want, and can visit homes for you and send photos and videos if you are still in the U.S.

🗣️ Step 4: Interview Two or Three Agents and Ask for References

  • Get referrals: ask friends or neighbors who bought in Los Cabos who they used and if they would hire them again.
  • Interview more than one: a short video call with two or three agents shows you who knows the market and who just sends links.
  • Ask for references: request contact details for two or three recent clients, ideally U.S. buyers like you.
  • Agree on communication: WhatsApp, email or video calls, and how fast they reply, especially if you are buying from the U.S.
  • Get the terms in writing: read any agreement before you sign, so you know what the agent will do for you.

📝 Questions to Ask Before You Hire an Agent

Ask A Good Answer
What is your (or your brokerage’s) license number? They give it right away, and they show up in the registry
Are you an MLS member? Yes, and they can show you listings from other brokerages
Which communities do you know best? They name specific communities and recent sales there
What have homes like mine sold for recently? Real MLS numbers: sold prices and days on market
How does the fideicomiso work? A clear, simple explanation of the bank trust and its costs
What will my closing costs be? An estimate in writing, with the notary, acquisition tax and trust fees
Where does my deposit go? To an escrow account, never to a personal account
How will we stay in touch? A clear channel and reply time that works from the U.S.
Can I talk to past clients? Yes, with names and contact details

🚩 Red Flags

  • No license number from the agent or their brokerage, or they avoid the question.
  • They ask you to send money to a personal account instead of escrow.
  • They only show their own listings and never homes from other brokerages.
  • They pressure you to sign fast or skip due diligence.
  • They can’t explain the fideicomiso or the role of the notary.
  • No references from past clients.

💵 Who Pays the Agent?

In Mexico, the real estate commission is usually paid by the seller at closing. As a buyer, you pay your own closing costs (acquisition tax, notary, fideicomiso setup, escrow and due diligence), but having your own agent normally doesn’t cost you extra.
